Abstract
In the present chronicle of jurisprudence, the contradiction reflected through judgments of the Criminal Chamber of the Supreme Court of Justice of Nicaragua, regarding the scope of the right to defense in criminal matters, specifically the right to technical defense in the hearing preliminary in the Nicaraguan criminal process, for this, three sentences of the Criminal Chamber of the Supreme Court of Justice are analyzed, No. 8 and No. 29, both of the year two thousand seven, and the sentence No. 20 of the year two thousand nine, emphasizing the procedural guarantees and particularly the right to defense recognized in our Political Constitution, in the Criminal Procedure Code and in some international treaties.En la presente crónica de jurisprudencia se la contradicción reflejada a través de sentencias de la Sala Penal de la Corte Suprema de Justicia de nicaragua , en torno al alcance del derecho a la defensa en materia penal, específicamente del derecho a la defensa técnica en la audiencia preliminar en el proceso penal nicaragüense, para ello se analizan tres sentencias de la Sala Penal de la Corte Suprema de Justicia , la No.8 y No.29, ambas del año dos mil siete, y la sentencia No. 20 del año dos mil nueve, haciendo énfasis en las garantías procesales y particularmente el derecho a la defensa reconocidos en nuestra Constitución Política, en el Código Procesal Penal y en algunos tratados internacionales
